Terms of Service

Welcome to burti. These Terms of Service ("Terms") govern your access to and use of the burti app and website (the "Service"). By creating an account or using burti, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use burti

You must be at least 13 years old to use burti. If you create an artist account or receive payouts, you must be at least 18 and able to enter a binding contract. You're responsible for keeping your login secure and for activity on your account.

2. Your account

You can sign in with Apple, Google, or email. You agree to provide accurate information and to keep it current. You can delete your account at any time from Settings → Delete Account.

3. Subscriptions & payments

• Fans support artists by subscribing on a monthly basis. Prices are set by each artist and shown before you pay.
• Payments are processed by our payment provider (Paystack). burti does not store your full card details.
• Each subscription grants access until its stated expiry date, after which it ends. Subscriptions do not auto‑renew unless stated — you renew an artist when you choose to.
• Except where required by law, payments are non‑refundable. If you believe you were charged in error, contact us.

4. Artists, content & payouts

• Ownership. Artists retain ownership of the content they upload ("Drops"). Fans and burti do not acquire ownership of that content.
• Licence to burti. By uploading content, artists grant burti a non‑exclusive licence to host, store, process, stream and display that content to subscribers in order to operate the Service.
• Access, not resale. A subscription gives you personal access to an artist's Drops. You may not copy, redistribute, sell, or publicly share that content.
• Payouts. Artists earn from subscriptions, less a platform fee disclosed in the app. Payout availability and timing may vary and are subject to verification and applicable law.
• Responsibility. Artists are responsible for the content they post and confirm they have the rights to share it.

5. Acceptable use

You agree not to:

• Upload content you don't have the rights to, or that infringes others' rights.
• Post unlawful, harmful, hateful, harassing, or sexually exploitative content, or content that endangers minors.
• Attempt to break, abuse, reverse‑engineer, or disrupt the Service, or bypass payment or access controls.
• Scrape, redistribute, or resell content or data from the Service.

We may remove content and suspend or terminate accounts that violate these Terms.

6. Content moderation & reporting

You can report content within the app. We review reports and may remove content or take action on accounts at our discretion to keep burti safe.

7. Termination

You may stop using burti and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service and its users. Some provisions (such as ownership, disclaimers, and limits of liability) survive termination.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the Service will be uninterrupted, error‑free, or that content will always be available.

9. Limitation of liability

To the fullest extent permitted by law, burti will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid to burti in the 12 months before the claim.

10. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by notifying you in the app. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict‑of‑laws rules. Disputes will be subject to the courts located in Nigeria, unless a mandatory local law provides otherwise.
